The second of two males charged with dangerous driving causing the death of Mitchel Lee Tibbets has entered pleas of not guilty and been remanded until trial.
Brian Kyle Schriver, 19, of Bath was returned to Woodstock court Wednesday after undergoing a psychological assessment at the Restigouche Health Center.
Schriver is charged with operating an all-terrain vehicle (ATV) in a manner dangerous to the public causing the death of Tibbets and leaving the scene of the accident on School Street in Bath on July 12.
On Wednesday, Schriver was deemed fit to stand trial with no objection from the defence. He also pleaded not guilty to the two July 12 charges, as well as numerous other charges laid against him, and elected trial by provincial court judge.
With the Crown objecting to his release, a bail hearing was held in the late morning hours.
Upon conclusion of evidence by the Crown and arguments by prosecutor Ken Oliver and defence counsel James Crocco, Judge Henrik Tonning ordered Schriver be remanded until his trial.
The matter was set over until Tuesday, Aug. 19, to set trial dates at 11 a.m.
Schriver is also charged with break, enter and theft at a Richmond Corner residence on Oct. 21, 2007; theft of a Husqvarna chainsaw in Kilfoil on May 20, 2008; theft of gas from Coldstream Convenience on May 21, 2008; break, enter and theft in Kilfoil on May 22, 2008; recklessly causing damage by fire to a 2004 Bombardier off-road vehicle in Kilfoil between May 20 and 25, 2008; break, enter and theft into five trailers parked at Dedicated Freight in Jacksonville on June 5, 2008; and break, enter and theft at a Johnville residence on June 20, 2008.
Jason Donald Davenport, 29, of Beechwood is also charged with dangerous operation of a motor vehicle causing death. He has pleaded not guilty to the charge and has elected trial by judge and jury. He is also remanded until his trial.
